Welcome to Naugam1000 Esport School (“Naugam1000”, “we”, “our”, “us”). By accessing our website at Naugam1000.lol, creating an account, or purchasing coaching, you agree to these Terms. If you do not agree, do not use our services.

1) Scope & Definitions

These Terms govern your use of our website, communications, and any coaching services, resources, or materials provided by Naugam1000. “Services” means our coaching sessions, guides, playbooks, VOD reviews, practice plans, events, and related features.

2) Changes to Terms

We may update these Terms to reflect changes in our Services or applicable laws. When we do, we will post the new version with the “Last updated” date. Continued use after changes means you accept the revised Terms.

3) Eligibility & Accounts

• You must be at least 16 years old or have verifiable parental/guardian consent.
• You are responsible for maintaining the confidentiality of your account and for all activities under it.
• Notify us immediately at legal@Naugam1000.lol of any unauthorized use or security incident.

4) Coaching Services

• Coaching may include live sessions (Discord/voice/screen share), VOD analysis, drill sheets, KPI trackers, and team systems.
• We may recommend routines, but you are responsible for your practice time, hardware settings, and in-game conduct.
• We may adjust coaches or schedules to deliver Services effectively (e.g., illness, time-zone shifts).

6) Rescheduling, Cancellations & Refunds

• Rescheduling: Allowed with at least 24h notice. We will offer alternative slots subject to coach availability.
• No-shows/late cancellations: May be charged in full.
• Refunds: If you cancel before any session is delivered, we may provide a refund (minus processing fees). After delivery has started (e.g., intake, prep time, materials), refunds may be partial or unavailable depending on work performed.
• Coach cancellations: If we must cancel, you can reschedule or request a refund for the undelivered portion.

7) Acceptable Use & Fair Play

• No harassment, hate speech, threats, doxxing, or abusive behavior in sessions or community spaces.
• No cheating, boosting services, or distribution of cheats/macros/exploits. We will not assist in violating game ToS.
• Respect IP laws: do not upload content you do not have rights to share.
• We may suspend or terminate access for violations without refund where legally permitted.

8) User Content & License

“User Content” includes VODs, clips, messages, feedback, or other materials you share.

• You retain ownership of your User Content.
• You grant Naugam1000 a non-exclusive, worldwide, royalty-free license to use, reproduce, display, adapt, and create derivative works of User Content solely to provide and improve the Services (e.g., reviewing your VOD, preparing drills).
• You represent that you have the rights to provide such content and that it does not infringe the rights of others.

9) Our Intellectual Property

• All materials we provide (playbooks, drills, templates, VOD notes, branding, text/graphics) are protected by IP laws.
• We grant you a personal, non-transferable, non-exclusive license to use materials for your own training. Redistribution or commercial use is not permitted without our written consent.

10) Third-Party Links & Tools

Our site may link to third-party websites or tools (e.g., Discord, payment gateways). We are not responsible for their content or policies. Your use is subject to those third parties’ terms and privacy policies.

11) Disclaimers

• We provide coaching and educational content; we do not guarantee specific rank increases or competition outcomes.
• Services are provided “as is” and “as available,” to the fullest extent permitted by law. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12) Limitation of Liability

To the fullest extent permitted by law, Naugam1000 and its coaches, employees, and partners will not be liable for indirect, incidental, special, consequential, or punitive damages; or any loss of profits, data, goodwill, or business interruption. Our aggregate liability for any claim relating to the Services will not exceed the amount you paid to us for the Service that gave rise to the claim in the 12 months preceding the event.

13) Indemnity

You agree to indemnify and hold harmless Naugam1000 from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Services.

14) Consumers & Right of Withdrawal (EU)

• If you are an EU consumer, you may have a 14-day right of withdrawal for distance contracts. However, when you request that we start providing Services during the withdrawal period, you acknowledge that you may lose the right of withdrawal once the Service is fully performed, and you will owe a proportionate amount for any Services already provided.

15) Governing Law & Venue

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law principles. Courts located in Amsterdam, the Netherlands, will have exclusive jurisdiction, except where mandatory consumer protection laws provide otherwise.

16) General Provisions

• Severability: If any provision is found unenforceable, the remainder remains in effect.
• Assignment: You may not assign these Terms without our consent. We may assign in connection with a merger, acquisition, or sale of assets.
• Force majeure: We are not liable for delays or failures due to events beyond our reasonable control.
• Entire agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement regarding the Services.
• No waiver: Our failure to enforce a provision is not a waiver.
• Notices: We may provide notices via email, on-site messages, or updates on this page.
